Appeal against decision [[2013] FWC 5369] of Deputy President Smith at Melbourne on 30 September 2013 and Response to Full Bench Order [[2014] FWC 334] of Deputy President Smith at Melbourne on 24 January 2014 in matter number AM2012/132 and others, determination [PR539921] of Deputy President Smith at Melbourne on 1 October 2013 in matter number AM2012/179 and AM2012/240, and determination [PR541744] of Deputy President Smith at Melbourne on 1 October 2013 in matter number AM2012/172.

Pursuant to its decision of 3 April 2014 [2014] FWCFB 2228 in matter C2013/6468 and s.607 of the Fair Work Act 2009 (Cth) (the FW Act), the Fair Work Commission orders:

1. That paragraphs [8]-[19] of Deputy President Smith’s decision of 30 September 2013 [[2013] FWC 5369] and all of Deputy President Smith’s response to a full bench order [2014] FWC 334] be quashed.

2. That item 8 of Deputy President Smith’s determination of 1 October 2013 [PR539921] be quashed.

3. That the 1 October 2013 determination of Deputy President Smith [PR541744] be quashed.

4. That the matter that is the subject of matter C2013/6468 be referred to the President of the Fair Work Commission having regard to the Four Yearly Review of Modern Awards being undertaken under s.156 of the FW Act.
