4 yearly review of modern awards –alleged inconsistencies with NES.
A. Further to the Full Bench decisions issued on 23 December 2014 1 and 8 May 20152,the above award is varied as follows:
1. By deleting clause 25.2(c) and inserting the following:
(c) Leave allowed before due date
(i) An employer may allow an employee to take annual leave prior to the employee’s entitlement otherwise arising.
(ii) Where an employer has allowed an employee to take annual leave prior to the employee’s entitlement otherwise arising and the employee’s services are terminated (by whatsoever cause) before the right thereto has accrued,the employer will be entitled to deduct from any remuneration payable any excess due on account of such annual leave payments.
B. This determination comes into force from 16 October 2015.
