4 yearly review of modern awards –alleged inconsistencies with NES.
A. Further to the Full Bench decisions issued on 23 December 2014 1 and 8 May 20152,the above award is varied as follows:
1. By deleting clause 34.2 and inserting the following:
34.2 The employer may allow annual leave to an employee before the right thereto has fully accrued.
2. By deleting clause 34.3 and inserting the following:
34.3 Where annual leave has been granted to an employee pursuant to clause 34.2 before the right thereto has accrued,and the employee subsequently leaves or is discharged from the service of the employer before completing the service in respect of which leave was granted,the employer may deduct the cash equivalent of the unearned leave which amount will not include any sums paid for any of the holidays prescribed by clause 37—Public holidays.
B. This determination comes into force from 16 October 2015.
