4 yearly review of modern awards –alleged inconsistencies with NES.

A. Further to the Full Bench decisions issued on 23 December 2014 1 and 8 May 20152,the above award is varied as follows:

1. By deleting clause 19.2 and inserting the following:

19.2 Annual leave taken before due date

(a) If so requested by an employee,the employer may allow annual leave to an employee before the right thereto has accrued.

(b) Termination where annual leave is taken before due date

    Where annual leave has been granted to an employee pursuant to clause 19.2(a) and the employee subsequently leaves or is discharged from the service of the employer before completing the service in respect of which the annual leave was granted,the employer may deduct the amount of such excess from any remuneration payable.

B. This determination comes into force from 16 October 2015.
