Application to vary modern award to achieve modern awards objective – clause 10.4 – part-time employment – Vehicle Repair, Services and Retail Award 2020.
A. Further to the decision issued by the Fair Work Commission on 9 January 2024 [[2024] FWC 48], the above award is varied as follows:
1. By deleting clause 10.4 and inserting the following:
10.4 Any agreed variation to the hours of work will be recorded in writing (including by electronic means). Any such agreement may be ongoing or for a specified period of time.
B. This determination comes into operation on 9 January 2024. In accordance with s 165(3) of the Fair Work Act 2009 (Cth) this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 9 January 2024.
