An employee is a shiftworker whenever they work their ordinary hours during a shift that finishes between 7pm and 7am.
This means that an employee can switch between being a shiftworker and a non-shiftworker from shift to shift, depending on when they finish their ordinary hours.
Temporary Schedule I – Award Flexibility During the COVID-19 Pandemic
Between 28 March 2020 and 30 June 2021, Schedule I of the Clerks Award temporarily provided for award flexibility due to the COVID-19 pandemic. See Clerks Award flexibility during coronavirus.
Under Schedule I, employees who had agreed with their employer to do remote work could agree to work their ordinary hours between 6am and 10pm Monday to Friday, and between 7am and 12.30pm on Saturday.
Even though they could work hours that finished between 7pm and 7am, day workers doing remote work weren’t shiftworkers under the Clerks Award, and didn’t get paid shift penalty rates.
