Employees get paid additional amounts when they do evening and night work, Monday to Friday.

Different amounts apply from:

  • 7pm to midnight
  • midnight to 7am.

The additional amounts are paid for every hour or part of an hour worked.

The additional amounts are paid in addition to:

  • 100% of the ordinary hourly rate for full-time and part-time employees
  • 125% of the ordinary hourly rate (inclusive of the casual loading) for casual employees.

Where there's more than one penalty rate that applies to the hours being worked, employees get paid the higher penalty rate.

Example

Jana is a part-time employee. Jana worked a shift from 5pm to 9.15pm.

For the time after 7pm Jana gets paid 100% of her ordinary hourly rate and the evening additional amount.

Jana worked for 2 hours and 15 minutes after 7pm.

Jana gets paid the evening additional amount for 3 hours. This is because she worked two full hours and one part hour after 7pm.

Jana worked overtime the next evening from 7pm to 11pm. She gets paid overtime for the 4 hours of work, and not the evening penalty rate. This is because the overtime penalty rate is higher than the evening penalty rate.

Additional workplace flexibility in the Hospitality Award

From 3 September 2021, new schedules (Schedule I and Schedule J) that allow employers to pay certain full-time employees loaded rates have been added to the Hospitality Award.
