Employees get paid the following penalty rates for hours worked between 6pm and 6am Monday to Friday:

  • 121.7% of the minimum hourly rate for full-time and part-time employees
  • 146.7% of the minimum hourly rate for casuals.

Example

Arjun is a part-time employee. On Thursday, Arjun worked from 3pm to 8pm. For this shift, he gets paid:

  • his minimum hourly rate between 3pm and 6pm
  • 121.7% of his minimum hourly rate between 6pm and 8pm.

Permanent night work

Employees are doing permanent night work if more than two thirds of their shifts in a roster cycle include hours worked between midnight and 6am.

The permanent night work penalty rate is:

  • 130% of the minimum hourly rate for full-time and part-time employees
  • 155% of the minimum hourly rate for casuals.

It’s paid for hours worked between 6pm and 6am.

Example:

Arjun’s employer has a two week roster cycle, and he works 10 shifts each fortnight.

Arjun checks the roster and sees that 7 of his shifts include hours between midnight and 6am.

More than two thirds of Arjun’s shifts have hours between midnight and 6am. This means that Arjun gets paid 130% of his minimum hourly rate for the hours he works between 6pm and 6am.
