Overtime worked on any day stands alone.
This means that you calculate overtime pay separately for each shift that overtime is worked.
Example: Overtime on more than one shift
Pasquale is a full-time employee.
He worked 2 hours of overtime on Tuesday and 3 hours of overtime on Thursday.
Pasquale’s employer pays him 2 hours at 150% of his minimum hourly rate for the overtime worked on Tuesday
The overtime Pasquale worked on Thursday is calculated separately and he’s paid 150% of his minimum hourly rate for 2 hours and 200% of his minimum hourly rate for 1 hour.
What happens if a shift goes past midnight?
The overtime period continues even if the shift goes past midnight.
Example: Overtime continues past midnight
Paris is a full-time employee.
She worked 4 hours of overtime from 9pm on Wednesday to 1am on Thursday.
Paris is paid 150% of her minimum hourly rate for the first 2 hours of overtime, from 9pm to 11pm Wednesday and 2 hours at 200% of her minimum hourly rate for the rest of her overtime shift.
Temporary workplace flexibility in the Restaurant Award
From 11 August 2021 to 10 August 2022, temporary schedules (Schedule AA and Schedule R) were added to the Restaurant Award. These schedules allowed changes to classifications, pay rates and allowances.
