Employees who don’t earn commission get a 17.5% annual leave loading. This is paid on the minimum rate.

Employees who earn commission get the higher of the:

  • average of commission payments earned in the last 12 months, or
  • 17.5% annual leave loading paid on the minimum rate.

Example

Nick is a commercial traveller who earns a weekly commission.

Nick’s average commission for the last 12 months is $110 per week. His minimum weekly rate is $800.

His employer compares his average commission to the 17.5% annual leave loading.

Annual leave loading of 17.5% on $800 a week is $140.

When Nick takes annual leave he'll get paid the annual leave loading because it's higher.
