Casuals are paid overtime if they work:
- more than 8 hours in a day
- outside the span of hours of 4am to 5pm Monday to Friday.
Overtime for working more than 38 hours in the week is not paid to casuals.
Example
Gord is a casual labourer covered by the Waste Award.
He sometimes picks up shifts covering permanent employees when they’re on leave.
One week his work hours were from 9am – 5.30pm. That week he worked 8 hours a day for a total number of 40 hours in the week.
Gord was not paid any overtime because he didn’t work more than 8 hours in a day or outside the span of hours.
Overtime rates
When working overtime, casuals are paid:
- 160% of their ordinary rate for the first 2 hours
- 210% of the ordinary rate for overtime after 2 hours.
Included in the overtime rate is a 10% loading instead of the 25% casual loading.
Example
The following week Gord was back in his regular role.
One day he was asked to work for 6 hours. Before he finished his shift he was asked if he could help finish off a big job that had come in.
Gord worked for 9 hours.
Because his shift was longer than 8 hours he was paid overtime for 1 hour and his ordinary hourly rate for 8 hours.
