Non-shiftworkers
Casuals who aren't shiftworkers get paid overtime if they work:
- more than 38 hours in a week, or an average of 38 hours over a period
- outside the spread of hours for the kind of work they do
- more than 5 days in one week.
For most employees, hours can be averaged over a period of 2 weeks or 4 weeks. Different averaging rules are set out in the award for:
- curriculum/resources services employees employed in outdoor education
- boarding supervision services employees.
Example
Thomas is a casual school administrator, who works for a high school.
School administrators can work ordinary hours between 7am and 6pm on weekdays.
On Thursday, Thomas worked from 12pm until 8pm.
Thomas gets paid overtime for the 2 hours worked past 6pm on Thursday.
Shiftworkers
Casual shiftworkers get paid overtime if they work more than 10 hours in any one shift (including a meal break).
