Overtime on Monday to Saturday
Employees working overtime from Monday to Saturday get paid:
- 150% of their minimum hourly rate for the first 2 hours
- 200% of their minimum hourly rate for the hours worked after that.
If an employee works overtime that continues after midnight into the next day, their overtime pay rate resets after midnight.
This means that the overtime rate may reset to 150% even though the employee has already worked 2 hours in the same shift. The overtime rate won’t reset to 150% if the following day is a Sunday or public holiday.
Example
Samir has already worked 38 ordinary hours in a week. He starts his next shift, which is overtime, at 9pm on Friday and finishes at 9am on Saturday.
Samir gets paid the following overtime pay rate:
- 150% from 9pm to 11pm on Friday
- 200% from 11pm to midnight on Friday
- 150% after midnight to 2am on Saturday
- 200% from 2am on Saturday until the end of his shift.
There is nothing in the award which stops an employer from agreeing to keep paying employees 200% of their minimum hourly rate for overtime which continues after midnight.
Overtime on Sunday or a public holiday
Employees working overtime on Sunday or a public holiday get paid:
- 200% of their minimum hourly rate for all hours worked on Sunday
- 250% of their minimum hourly rate for all hours worked on a public holiday.
If an employee works overtime that continues into Sunday or a public holiday, their overtime pay rate does not reset to 150% after midnight. They will get paid the relevant Sunday or public holiday overtime rate.
Example
Samir has already worked 38 ordinary hours in a week. He starts his next shift, which is overtime, at 9pm on Saturday and finishes at 9am on Sunday.
Samir gets paid the following overtime pay rate:
- 150% from 9pm to 11pm on Saturday
- 200% from 11pm to midnight on Saturday
- 200% after midnight to 9am on Sunday.
