A portable toilet business provides one or more of the following services in relation to portable toilets:

  • cleaning
  • delivery
  • on-hire
  • removal of waste.

Industry award coverage

An industry award can cover an employee of a portable toilet business if:

  • their employer operates in the industry defined in the award
  • there's a classification which matches the employee's duties and qualifications.

Retail Award

The Retail Award covers an employer if they're in the business of hiring portable toilets.

For example: supplying crossovers, portable toilets and temporary fencing to the building industry.

Cleaning Award

The Cleaning Award covers an employer in the contract cleaning services industry.

The contract cleaning services industry means providing cleaning services under a contract.

An employer who is contracted to provide a cleaning service of the portable toilets will be covered by this Award.

Road Transport Award

The Road Transport Award covers an employer in the business of transporting portable toilets. The employer doesn’t provide other services in relation to the portable toilets.

Waste Award

The Waste Award covers an employer in the business of collecting, transporting, handling, recycling and disposing of the waste material.

No industry award coverage

If an employee of a portable toilet business isn’t covered by an industry award, they may be:

  • covered by an occupational award, like the Clerks Award
  • covered by the Miscellaneous Award, or
  • award free.

Miscellaneous Award

The Miscellaneous Award can cover an employee of a portable toilet business if the employee:

  • is not covered by an occupational award, like the Clerks Award
  • is not a professional employee.

An employee may be considered a professional employee if their role requires a degree qualification, for example, a bachelor degree in marketing or social media. The Miscellaneous Award doesn't cover professional employees.

Award free employees

Employees of a portable toilet business who aren't covered by an industry or occupational award or the Miscellaneous Award are award free.

Award free employees are entitled to the national minimum wage and the National Employment Standards.
