Day workers ordinary spread of hours is between 6.00am and 6.00pm on Monday to Saturday.
The ordinary spread of hours can be moved up to 1 hour forward or back by agreement with an employer. For example, from 7am to 7pm or 5am to 5pm.
Shiftworkers
Employees are shiftworkers if their rostered shifts are:
- Afternoon – finishing after 6.00pm and at or before midnight
- Night – finishing after midnight and at or before 8.00am.
Employees working rostered shifts outside of these periods are day workers.
Work outside the spread of hours
A day worker is paid overtime for the hours they work outside the spread, including if they are rostered to start or finish outside the spread of hours.
The hours that they are rostered to work before the spread of hours starts are considered to be part of their ordinary 38 hour week.
Example
Sienna is a level 2 process attendant. She cleans, fillets, weighs and packs fish in a seafood processing factory. The spread of hours for day workers in Sienna’s factory is 6.00am to 6.00pm.
Sienna is rostered to work each day on weekdays commencing at 4.00am and finishing at midday. Sienna’s hours do not fall within the shiftworker definitions. She is a day worker.
Because the period from 4.00am – 6.00am is outside the spread of hours for day workers, Sienna is paid 2 hours overtime.
The period from 6.00am to midday is paid at Sienna’s ordinary rate of pay.
The period 4.00am – 6.00am form part of Sienna’s 38 ordinary hours of work.
