Employees not covered by the national system are known as non-national system employees. The Fair Work Act 2009 provides some entitlements to non-national system employees. See Non-national system entitlements in the Fair Work Act 2009 for more information.

Sole traders in Western Australia generally aren't covered by the national system.

However, if a sole trader has an employee whose employment is based in a different state or territory, they will generally be covered by the national system in respect to that employee.
